Biden Orders Made In America

By IPVM Team, Published Jan 28, 2021, 11:23am EST (Info+)

In his first week in office, US President Joe Biden issued an executive order tightening Buy American regulations, and "stopping federal agencies from waiving Buy American requirements with impunity."

In this note, we look at this order and Biden's remarks, how it compares to existing regulations, and how it might impact the security industry.

Its a red herring. Politics. Waivers are there and used because you can't get those items being waived in the USA. That won't be changing anytime soon. Moving the 50% requirement higher and other restrictions will just increase the required waivers.

I became a fan after meeting Joe before he was VP and talking to him one-on-one for a while. We mostly talked about growing up blue collar with Irish immigrant parents.

The one thing that I completely disagree with is...It's been many many years since Joe's had as much hair as is being shown in the sketch for this article!

Hopefully, companies such as Motorola will give us other US manufactured products other than proprietary products such as Avigilon that are available to other dealers that do not qualify to sell lines such as Avigilon.

This goes for other manufacturers as well. Would love to offer a US made product, but our volume does not allow us to qualify to sell one.

Hash, does Avigilon put "Made in USA" stickers on its COTS products? With how the FTC requires it, Complying with the Made in USA Standard | Federal Trade Commission it's a very difficult mark to achieve in electronic products as it implies that "all or virtually all" components (sensor, lens, plastic enclosure, PCBs, POE, connectors, chips) are made in the USA. Asking as a US manufacturer myself who honestly designs and assembles everything in the USA but still scared to put a Made in USA sticker on the products due to foreign components inside.

Hey Michael,

COTS items would be labeled by the OEM's as to where they are manufactured. As for electronic items I believe the wording "Manufactured in" is more appropriate since as you pointed out the components themselves are "made" all over the place.

I think something like a baseball bat might be more appropriate for "Made in USA" since you could grow the tree in the USA, turn it on a lathe in the USA with USA labor and ultimately sell it.

But IANAL and do not officially speak for Avigilon/MSI on this matter.

Hash, "Buy American" regulation refers specifically to the qualified claim "Made in the USA" and not "Manufactured in the USA" or anything else. So if the product is "Manufactured in the USA" legally it still does not make it any different from the one made in China. Indeed people who wrote the regulation (during previous administrations) were thinking about baseball bats and not about electronics!

I know you're not naive to politics but I'll reply.

It's simple. Many do not trust the administration based on Joe Biden's personal business with other countries. It's certainly not a myth. It's been widely reported (AP, WSJ, etc.) and federal agencies are investigating.

Of course the administration is going to make every effort to give a different appearance.

Biden's appointment to lead the Justice Department will likely ensure that the investigation is wrapped up nicely for Joe.

It's politics.

Let's revisit this article in one or two years to see where the administration is on this.

I have heard many stories about Hunter Biden but I have not heard that directly about Joe Biden himself, citation?

Of course the administration is going to make every effort to give a different appearance.

I was told by many industry people as soon as Biden became President, the NDAA ban would fall and China would be welcomed back with open arms.

Listen, maybe it's appearances, I don't see it yet but if someone has better evidence, please share.

Also, Biden's Secretary of State confirmed that he believes genocide is being committed against Uyghurs in China. If Biden wants to make friends with China, this is the wrong way to do it.

I have heard many stories about Hunter Biden but I have not heard that directly about Joe Biden himself, citation?

It's interesting you would categorize what you heard as "stories" considering there are Senate committee hearings (examples: 1, 2, 3,) and federal investigations (DNI, FBI and DOJ) underway into the Biden family business dealings. Joe Biden is not immune to these investigations considering a significant part of them specifically deal with conflicts of interest with Joe Biden's position at the time his son was selling access to him.

I'm not going to list every piece of evidence because none of us have access to all of the evidence being reviewed by federal officials, but we do have access to various official reports, statements, and published material such hundreds of leaked documents, audio of calls between Joe Biden and Proshenko, audio of Hunter Biden stating that Devon Archer named he and his father, the credible Tony Bobulinski presser and interview stating that Joe Biden was involved, and more.

It's a clumsy argument for anyone to claim Joe Biden is not somehow involved. In fact, the nature of the crimes were to to hide his involvement. If you are falling for it you are not being objective.

There is enough truth available to form an objective opinion if you're truly wish to find it.

Edit: I forgot to mention the investigation of the campaign donation loophole being reported today. It involves $70M in donations by China to the University of Pennsylvania Biden Center (est. 2017) allegedly laundered to Joe Biden and his campaign. This would qualify as direct involvement. Although, I wouldn't be surprised if his son is involved.

On a related note, it would have been nice to see the Georgia State Farm arena vote counting video footage with some Axis Q1659 cameras wouldn't it?? Even though the footage that was provided clearly showed the 4 large cases of ballots coming out from under the skirted table after all the observers were told there would be no more counting, and even though you can also see the same ballots from those cases being run through the scanners multiple times on at least two machines, a super high resolution view would make the denials much more difficult and absurd.

Rather ironic that a security camera manufacturer does not want to review video evidence. If someone or some group can simply explain away what the equipment from your company/employer captures then your company's/employer's products are not very useful to the end user. It puts a serious dent in the value, don't you think?

If you could tell me about the court cases where the video evidence was actually reviewed in open court, such as a link to news coverage of the court hearings, or a link to transcripts of the testimony in open court as the video evidence was being reviewed, similar to the state level house/senate committee hearings where the evidence actually was presented, I will certainly go and take a look. I pretty much always prefer to review the actual evidence, as opposed to being told what to think about the evidence without ever having seen it.

This MFG is ALL for the video being submitted and reviewed in a court of law as evidence.

But as the state election official explains here at the 2:30 mark Georgia election official explains State Farm Arena video ("enter into evidence will lead to sanctions").

The reason you cannot find a court case with the video submitted as evidence is because the lawyer would need to characterized the video in a court of law and could be disbarred for giving false testimony, that you are not subject too in the venues you refer too.

They were not willing to go that far with the State Farm video and they still went too far.

Lawyer May Face Discipline in Election Case

Attorneys risk disciplinary action over wave of election suits

If you can find an attorney willing to take the risk

[Given the obvious risk, their willingness would put a serious dent in their value.] (Ironically Trump could not find anyone willing to do it )

BY ALL MEANS, GO FOR IT SUBMIT THE VIDEO TO A COURT, PLEASE

At some point, please explain your reference to "cases being run through the scanners multiple times on at least two machines" and why the discrepancy did not show up in the subsequent recount or the hand count. But of course you are not subject to the same standard as a court of law here, so it should be easy to explain.

Oh my and good grief. Thanks for making my point about how you're being told what to think.

Your first link is Gabe Stirling making some of his many excuses and establishes nothing. Your next 3 links express ridiculous opinions from left wingers hoping to punish anyone who dared challenge the fraud. Also completely nothing.

My comment was "...ballots from cases being run through multiple times."

Now you are correct that they were not "suitcases". When I watched the video I could clearly see that they were not suitcases, so I don't know why that word was ever used, but in any event it is irrelevant other than it was used as a deflection by the left. And even though I just said "cases", you dutifully regurgitated the left wing talking point, so you have been conditioned well.

The GA election officials in the link you sent showed very little. There was no clear connection of when the cases were loaded and put under the table. Gabe Sterling's claims can be debunked by simply watching news reports. In any event, if counting was going to continue or resume, they should have waited until observers returned. The observers were told that counting was going to stop, the media reported that counting was going to stop, so both observers and the media left.

A few simple questions for you:

1. Did you know that skirted tables are a violation of GA state law?

2. Why have skirted tables at all, except to hide things in order to cheat? Why put ballots under a skirted table?? Why not put them on top of the table??

3. Why keep observers so far away, with no high def video (assuming Corona was a huge danger) such that observers can see everything, including the text and choices on the ballots, except to cheat?

4. Ever been to a casino and tried handing money directly to a dealer? What do they do with the money when you buy chips at the table? Is there ever a time where cameras cannot clearly see exactly how much money and how many chips are involved in every single transaction?? Why do casinos not work on the honor system like all of these vote counting locations did? Just a single cursory view of any of that footage shows what a total joke the "observation" was. The only thing that could be seen from that distance was movement of cases and stacks of ballots. And the room was even curved such that some parts of it could not be seen at all.

5. Have you actually watched the video of the same ballots being counted multiple times?? Try actually explaining that one.

6. For what possible reason would scanned ballots come right back out the top of the counting machine instead of going into a locked and sealed box??? Unless you wanted to be able to cheat by counting the same ones multiple times.

FYI, there are numerous sworn witnesses to the recounts you're touting, and the "recounts" were not what you imagine they were. Let's just say that if the chain of custody issue alone were attempted with evidence in a court of law, it would be thrown out immediately.

FYI 2, there are other videos showing ballots being scanned more than once.

Evidence of voter fraud in swing states has never been given a judicial venue. Most every case has been dismissed on standing, not the merits of the case. The courts do not want to touch it. That's why these cases are moving through various appeals and up to the Supreme Court.

I challenge any election fraud denier to show the case where the State Farm video has been reviewed by a judge or jury as of today. For that matter, show ANY case where election fraud evidence has been reviewed by a judge or jury in any swing state that has a ruling. You can't.

"But the PEE TAPE!"

ICYMI on MSNBC, FBI declassified docs reveal Rod Rosenstein DID offer to wear a wire in coordinated swamp coup against WeTP in addition to this weeks felony conviction of FBI atty involvement at HOAX inception.

TDS Meme-inglessness incoming.

WHY PRESS THIS "POLITICAL" issue? Holding DC accountable has never been more urgent and vital to our industry.

THIS IS WHY WeTP or an industry must NOT be silenced by TDS or other influences. Thank you IPVM for the industry platform.

I would bet this is the first they've heard of the declassified docs about the wire or the recent conviction. They're focused on Joe's ice cream flavors and pets in the White House. Heck, they'll even circle back with you on those.

Dwayne, I was equally concerned with the POTUS elected in 2016 with regard to his business dealings internationally as well as domestically. And while I'm a JB fan, I hope that a proper investigation is carried out and any necessary consequences are ensured. Frankly and fairly, we are in a time when people trust others...especially the government...less than ever before. Seeing parties fight, shut the government down, and do other things that will negatively impact people and our country simply to keep to parting lines is a key factor in this distrust. Leaders being as transparent (even painfully so) will help to engender trust. Any level of transparency whether it be daily public briefings, access to agendas or personal tax information will be a good step forward. My naivete and likely over optimistic view is that we can get back to a point of respect for others even in disagreement.

Assuming all the above is true, how would creating a Made In America director and instructing all federal agencies to examine and report on waivers, followed by reporting in actual dollars the purchases which used waivers help him? That's a very aggressive stance to take. This EO could have been toothless but full of lots of nice words without instruction to do those things and still saved face if all that was true. And I say all these things as someone who is not a fan of Joe Biden.

Obviously once rules are released and we see how these things are actually enforced, we'll know how serious the administration is, but this is certainly positive on paper.

Zac, it's a relatively short list - Avigilon, some Arecont cameras, and maybe some specialty cameras.

Maybe. I mentioned Pelco earlier in the thread. Motorola has not made a public statement about the actual Pelco USA manufacturing start date. I've emailed Motorola asking if they have a planned or committed date for that and will post back if/what they respond.

Motorola response:

The first new [Pelco] camera design will ship out of an MSI factory in Q2 of this year with additional camera lines being added quarterly as refresh cycles come up.

That's sooner than I thought (less than 6 months away) and we will cover this more as it gets closer.

It all depends on the definition of "made in America." Actually fully made in the USA? I know that Avigilon is at least partly if not mostly made in Canada, albeit North America.

The question is, what cameras qualify under FARS and DFARS definition of "made in America"?

Avigilon manufacturers in Vancouver and Plano Texas. So they manufacture in Canada and the US.

Let the games begin.

There’s already enough confusion between “Buy America” and “Made in America” with percentages of value. Time to define “Assembled in America”?

I worked on a bid for an airport and the requirement was “Buy America” with Sony as a certified provider.

Plenty of comments in IPVM about the confusion.

The reason Sony was approved was due to an agreement along with some other countries designating them as an approved source, not specific to a product or technology.

I read a few postings, initially put-off by the perennial comments about the election and Biden, adding to the same type about Benghazi and Clinton and after the yellow cake and the Iraqi WMS, I would still like to hear from fellow integrators importing electronic components & devices from China.

The 25% duty on our imports from China should be cancelled immediately, allowing the similar counter duty that our Chinese customers get on their imports from the USA, and will return free trade to the land of the free.

Of course if that happens, we will not be able to continue supporting our farmers with the tax revenue as we have be subject to since September 2018, but I am sure that freedom of trade will allow them to take care of their own business as before...

Couldn't agree more. I remember when FREE TRADE existed in the "land of the free" 1960s, 1970s, 1980s. However, starting in 1980s politicians had a "good idea" and by 2019 USA shifted Mfg to a SOLE source foreign (Communist) power. THAT is UNFAIR trade. Politicians whose policy ($) traded "global free unfair trade" for a shinking USA middle class and diminished sovereignty was NOT good idea (blame Dem & Rep).

As an integrator I view 25% tariff as "motivation" to shift mfg out of Communist (not our friend) PRC. I gladly pay suppliers 15%-25% more to on-shore mfg. or out of China (VN, MX, CA, TWN, etc.). Price hike is no different from NOT sourcing from cheaper HIK or SNAPAV for past 15 years anyway. In other words, we accepted lower NET profit to NOT buy from a cheaper supplier who sole sourced out of China.

Who benefits? We saw it was working lower, middle class. In 2019 workers drove unemployment to lowest levels in decades (Black 5% lowest recorded). Those workers boosted domestic GDP. That GDP boost plus domestic energy independence pays down a $25T debt. Buying China is exact OPPOSITE. My take, big picture.

So removing any tariffs from either side would make it "fair" right?

Lets say Country 1 allows reimbursement from the government for all labor, no restrictions on pollution and zero interest loans, while allowing the theft of intellectual property.

Country 2 provides a "living wage", significant environmental regulation and prosecutes intellectual theft.

Is that also "Fair Trade"?

The reason for the COTS exception I believe is that virtually no electronic products, including those in the physical security space, can have a qualified tag Made in USA because most of the components come from the rest of the world. Even the mentioned above US-based Avigilon and other camera makers may struggle to put a Made in USA label since most CMOS imagers are made in Asia (even for US brands like OmniVision and On Semiconductor), PCB boards are almost exclusively from China, lenses are likely Chinese (little production in the USA at present), night LEDs are all Japanese or Chinese, resistors and capacitors - even Digi-Key/ Mouser distributors don't know where they are shipped from, etc.

To truly promote US manufacturing and to ensure domestic supply chain integrity, it would be much more meaningful to replace Made in USA requirement with Designed and Assembled in the USA.

Biden's address to Congress featured Buy America prominently, embedded below:

And all the investments in the American Jobs Plan will be guided by one principle: Buy American. Buy American.

And I might note parenthetically, that does not violate any trade agreement. It’s been the law since the ’30s, buy American. American tax dollars are going to be used to buy American products, made in America, to create American jobs. That’s the way it’s supposed to be, and it will be in this administration. And I made it clear to all my cabinet people, their ability to give exemptions has been strenuously limited. It will be American products.
