Saas Project - MBE And WBE Pass Through Rate?

Hello,

 

we have a SaaS based project that requires 35% MBE/WBE participation. As its SaaS there is nothing we can outsource to the subcontractor besides facilitating admin work for training. I would appreciate any guidance on the following:

1. Any way we could get a waiver

2. Absolute minimum % cut MBE/WBE takes to pass it through. ~$100K/year project.

Are you sure you weren't on the same phone call I was about 2 hours ago?!?

This is an interesting topic, as it seems to come up frequently on state-funded projects and usually affects both Division 28 (Security) and Division 27 (Low Voltage - Telecom). Quite often, the Division 28 work is complex enough and technical to the point of not being able to suitably be carried totally by the MBE/WBE that usually appears from the Division 27 side at the 11th hour of a bid and figures they should be able to carry everything under their entity in order to juice up the % of MBE/WBE participation for the GC's benefit.

The games begin from there, so I too am very interested in replies on this question.
